We Will Help You Through The Challenges Of Probate

It is always difficult when a loved one dies. Assets left in that person's name alone complicate the situation even more. Transferring assets to others can be confusing. Sometimes, family disputes erupt over who gets what when your loved one dies.

Your loved one's assets — all personal and real property — need a "home" after they die. For example, if a mother passed away and left a house in her name only, the probate process will assign it to the proper heir, or "home." Locating a will and gathering an inventory of your loved one's assets are frustrating for a grieving family. An experienced probate attorney can help you, the heirs.

At Donna J. Jackson & Associates, PLLC, our goal is to make the process as pain-free as possible for survivors and heirs. We take care of filing all the necessary documents to facilitate the process.

How Long Will It Take To Complete Probate?

Probate timelines vary with each family's circumstances. Oklahoma's probate laws govern how a probate judge will distribute your loved one's assets to the rightful people. Every estate is different. If a person dies with a valid will, that person is said to have died "testate." If someone dies without a will or without a valid will, then the person is said to have died "intestate." Dying intestate means Oklahoma probate laws generally govern who will get the assets of the deceased.

With either situation, it is advisable to speak with an attorney whether asset transfers need to be probated. Sometimes assets valued under $50,000 can be transferred out of the decedent's name and into the rightful heir's name with a small estates affidavit.

If your loved one simply left a transfer on death deed for their real property, this asset does not need to go through the probate process.
